Terms of Service

Welcome to Cat Toy! These Terms of Service ("Terms") govern your access to and use of the mobile application Cat Toy (the "App") developed and provided by YBR Digital ("we," "our," or "us").

Please read these Terms carefully before using the App. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not download, install, or use the App.

⚠️ CRITICAL DEVICE SAFETY & SUPERVISION WARNING

PLEASE READ: This App is designed specifically for pets (particularly cats) to interact with moving virtual toys on your mobile device's screen. Because pets may tap, strike, scratch, claw, or bite the device screen during play, you are entirely responsible for protecting your device. We strongly recommend using a high-quality glass screen protector and supervising your pet at all times during gameplay. We disclaim all liability for any physical damage to your device (including, but not limited to, scratched screens, cracked displays, screen failure, or physical damage from devices being knocked off surfaces) or any injuries to your pet.

1. Eligibility and Use

You must be at least 13 years of age, or the legal age of majority in your jurisdiction, to agree to these Terms. If you are under the legal age, your parent or legal guardian must review and agree to these Terms on your behalf before you use the App.

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on your mobile devices solely for personal, non-commercial pet entertainment, in accordance with these Terms.

2. Subscription and Purchases (Cat Toy Pro)

We offer a premium version of the App ("Cat Toy Pro") which unlocks additional custom toys, background colors, and gameplay settings.

  • Billing: Transactions, in-app purchases, and subscriptions are managed securely via RevenueCat and billed through the respective app store (Apple App Store or Google Play Store) associated with your device account.
  • Auto-Renewal: Subscriptions automatically renew at the end of the subscription period unless you cancel them at least 24 hours before the end of the current period.
  • Cancellation: You can manage and cancel your subscriptions at any time through your Google Play Store or Apple App Store account settings.
  • Refunds: Refunds for subscriptions or in-app purchases are governed by Google's and Apple's official refund policies. We do not directly issue refunds.

3. Prohibited Activities

You agree not to do any of the following:

  • Modify, adapt, translate, reverse engineer, decompile, or disassemble any portion of the App.
  • Distribute, sell, lease, or rent the App, or make its premium functionalities available to multiple users outside standard app store sharing rules.
  • Bypass, disable, or circumvent any security measures or license checks built into the App.
  • Use the App for any illegal purpose or in violation of any local, state, national, or international law.

4. Intellectual Property

All rights, title, and interest in and to the App, including but not limited to the source code, game engine integration (Flame), designs, graphics (such as beetle, mouse, butterfly, and fish sprites), sound effects, and logos are and will remain the exclusive property of YBR Digital and its licensors. The App is protected by copyright, trademark, and other laws of both India and foreign countries.

5. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL MEET YOUR OR YOUR PET'S EXPECTATIONS, THAT USER INTERFACES WILL BE UNINTERRUPTED, OR THAT THE APP IS FREE OF BUGS OR ERRORS.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL YBR DIGITAL, ITS DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

AS SPECIFIED IN THE DISCLOSURE WARNING, WE SHALL NOT BE LIABLE FOR ANY DAMAGE TO PERSONAL PROPERTY, INCLUDING MOBILE PHONES, TABLETS, COMPUTER SCREENS, OR PROTECTIVE CASES, CAUSED BY PETS AND/OR ANIMALS INTERACTING WITH THE APP.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Gujarat, India, and you hereby consent to the personal jurisdiction and venue therein.
