1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and YASH RAYJADA ("Developer", "we", "us", or "our"), governing your access to and use of the Live Billable Tracker mobile application for Android.
2. Description of the Application
Live Billable Tracker is an offline productivity tool designed for freelancers, contractors, and professionals to track billable work hours, monitor live earnings on a second-by-second basis, manage client projects with custom hourly rates and currencies, view visual analytics, and export records to CSV and PDF formats.
The App operates locally on your Android device without requiring internet access for time recording or database storage.
3. License & Intellectual Property
Subject to your compliance with these Terms, the Developer grants you a limited, non-exclusive, non-transferable, revocable personal license to download, install, and use Live Billable Tracker on your compatible Android device for personal or business productivity purposes.
Restrictions: You agree that you will not:
- Decompile, reverse engineer, disassemble, or attempt to derive the source code of the application.
- Modify, adapt, translate, or create derivative works of the software.
- Rent, lease, lend, resell, sublicense, or distribute the App without explicit written permission from the Developer.
- Remove or alter any proprietary notices, copyright marks, or branding affixed to the App.
4. User Responsibilities & Acceptable Use
You agree to use the App only for lawful purposes in compliance with all applicable local, national, and international laws and regulations. You are solely responsible for:
- The accuracy of any hourly rates, client information, currencies, notes, and session durations entered into the App.
- Ensuring your use of the App complies with any contractual billing agreements you maintain with your clients or employers.
5. Financial, Tax & Legal Disclaimer
The calculations, rates, session totals, and exported reports generated by the App are provided solely for your personal tracking and administrative convenience. You are solely responsible for:
- Verifying all hours, billable amounts, and currency conversions prior to submitting invoices or collecting payments from your clients.
- Compliance with your local tax laws, labor laws, and reporting standards.
- Resolving any payment or billing disputes with your clients or contracting parties.
6. Offline Storage & Data Backup Responsibility
Because Live Billable Tracker is a 100% offline-first application:
- All your projects, rates, sessions, and notes are stored solely inside your local device storage.
- Backup Safeguards: The App provides a built-in Backup (.lbt) and export feature. You are strongly advised to regularly export backup files and store them in a secure cloud or external location.
- No Cloud Recovery: The Developer does not maintain any external backup or copy of your records. The Developer is not responsible or liable for any loss, corruption, or inaccessibility of data resulting from device damage, OS updates, device resets, malware, or uninstallation of the App.
7. Device Permissions & System Features
The App utilizes Android system services to provide accurate time tracking:
- Foreground Service: Operates an ongoing background notification service during active timing sessions to ensure the operating system does not pause the calculation. You may stop this service at any moment by ending or pausing your timer.
- Home Screen Widget: You may place a Glance/AppWidget on your home screen for quick timer operations. The widget reads directly from your local on-device database.
- Network Permissions: Network access is used solely for viewing these online legal policy documents and navigating to official developer/store links.
8. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LIVE BILLABLE TRACKER IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE APPLICATION WILL OPERATE UNINTERRUPTED OR ERROR-FREE, THAT THE CALCULATIONS WILL BE FREE FROM HARDWARE TIMING ANOMALIES, OR THAT ANY DEFECTS WILL BE IMMEDIATELY CORRECTED.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER (YASH RAYJADA / YBR DIGITAL) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES WHATSOEVER, INCLUDING WITHOUT LIMITATION:
- Loss of profits, revenue, or business opportunities;
- Loss, alteration, or corruption of billing data or session history;
- Discrepancies in invoices sent to your clients;
- Device malfunction or battery performance variations.
IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY EXCEED THE AMOUNT PAID BY YOU (IF ANY) TO ACQUIRE THE APPLICATION.
10. Third-Party Links & Services
The App may contain links to external third-party sites, including our website (ybrdigital.in) and Google Play Store pages. We do not endorse or assume any responsibility for third-party websites, content, or services.
11. Termination
You may terminate this agreement at any time by uninstalling and ceasing all use of the App. We reserve the right to suspend or discontinue the App or update these Terms at any time without prior notice.
12. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any legal action or proceeding arising out of or related to these Terms shall be instituted exclusively in the competent courts located in Gujarat, India.
13. Modifications to These Terms
We reserve the right to revise or replace these Terms of Service at our sole discretion. Any changes will become effective immediately upon posting the revised version at this URL. Your continued use of Live Billable Tracker following any update signifies your acceptance of the revised Terms.
